Brazilian Association of Technical Standards (ABNT) sets new standards for dams and piles
The Brazilian Association of Technical Standards (ABNT) published new rules applicable to dams and piles, which address the following topics: (i) NBR No. 13,028 – development and presentation of dam projects for tailings disposal, sediment containment, and water reserve; (ii) NBR No. 13,029 – development and presentation of projects for the placement of overburdens in piles; (iii) NBR No. 17,188 – hypothetical rupture analysis in dams; and (iv) NBR No. 17,189 – dam instrumentation.
National Mining Agency (ANM) publishes Regulations No. 187/2024 and 188/2024, providing for the Crisis Management Policy and amending the Corporate Risk Management Policy
On November 4, 2024, National Mining Agency (ANM) Regulations No. 187/2024 and 188/2024 were published in the Federal Official Gazette, respectively providing for the Crisis Management Policy and amending Regulation No. 63/2021, which established the Corporate Risk Management Policy.
Suspension of environmental embargo penalties for rural properties: IN 08/24

The National Water Resources Council (CNRH) publishes Regulation No. 241/2024 and changes the general criteria for dam classification
On October 21, 2024, the National Water Resources (CNRH) Regulation No. 241 was published in the Federal Official Gazette. It revoked Regulation 143/2012 and established new general criteria for the classification of dams by Risk Category (CRI), Associated Potential Damage (DPA) and volume.
State of Mato Grosso publishes Decree regulating fee collection and registration of mining activities
On October 21, 2024, Decree No. 1,100/2024 was published in the Official Gazette of the State of Mato Grosso, regulating the fee and registration for controlling, monitoring, and inspecting the research, mining, exploration, and use of mineral resources, as established by Law No. 12,370/2023.
Low-Carbon Hydrogen Development Program will allow tax credits offsetting
On September 30, 2024, Law No. 14,990, of September 27, 2024, entered into force, providing for the Low-Carbon Hydrogen Development Program (PHBC).
