Exclusive: Attorney General’s Office for Federal Taxes (PGFN) monitors more than 3,000 State Tax on Goods and Services (ICMS) lawsuits based on Social Integration Program Contribution (PIS) and Social Security Financing Contribution (COFINS) credits

The Attorney General’s Office for Federal Taxes (PGFN) is monitoring 3,175 cases regarding the exclusion of the State Tax on Goods and Services (ICMS) from the Social Integration Program Contribution (PIS) and Social Security Financing Contribution (COFINS) credit base, according to data shared exclusively with Broadcast. In total, the lawsuits involve a disputed amount of BRL 1.2 billion. So far, according to lawyers following the issue, taxpayers have been able to secure preliminary injunctions in trial courts, but the scenario has been less favorable in the Federal Courts of Appeal (TRFs).
